Disability in the context of human rights: Philosophical reflection
Abstrakt
The presented publication addresses the issue of disability with an emphasis on its philosophical foundations, while noting that the liberal idea of a contractual model of social order and Kant's idea of human dignity based on rationality exclude large groups of the population from society, whose rights are not respected and the right to an independent life remains unfulfilled. In this regard, the publication also addresses the concept and content of human rights, their justification and individual approaches (M. Nussbaum, A. Sen), while emphasizing the shift from a medical understanding of disability (dysfunction, deviation from the norm) to a social construct. The authors point out that in the conditions of illiberal democracy with its emphasis on negative freedom, the position of persons with disabilities, the promotion of their rights and the provision of their specific needs is a Sisyphean task.
